The Case of The Constitution v. Communist Manifesto

A Summary of the Communist Manifesto
The Communist Manifesto represents a misguided philosophy, which teaches the citizens to give up their rights for the sake of the "common good," but it always ends in a police state. This is called preventive justice. Control is the key concept.
Read Carefully:
1. Abolition of private property.
2. Heavy progressive income tax
3. Abolition of all rights of inheritance.
4. Confiscation of property of all emigrants and rebels.
5. Central bank
6. Government control of Communications & Transportation.
7. Government ownership of factories and agriculture.
8. Government control of labor.
9. Corporate farms, regional planning.
10.Government control of education.
My comments:
To repeal laws and taxes already in place may seem lofty and idealistic to many, but remembering that: at first the laws and taxes restricting individual liberties are almost always blanketed with a facade of niceity and convenience for all. Fortunately for the sake of personal and property rights, the US Constitution is written to ensure individual freedom and protection of personal and property rights. The only rights we as a free people do not have are the ones we foolishly choose to forfeit for the "common good".
The "common good" by nature is not a principle of democracy, rather the principle of democracy is free market capitalism in a society governed by the highest common denominators, which I submit are the following: Love and Respect. Fear, is shallow and at best: the lowest common denominator, and those who submit to fear out of convenience are sadly misguided and have departed to the lowest animalistic instinct of one who is under attack.
Understanding security in a sovereign nation goes far beyond central power. It has often been said that the police arrive "after" an incident has ocourred. Now, most "civil" individuals do not contest law enforcement for the purposes of service and protection toward the general public. That is not an issue, however when the Constitution is jeopardized it is always an issue to the highest degree.
The greek word dunamis translates to power and literally means force, strength, power and is implicit of violence. Dunamis is most often used in a centralized sense or when referring to large ruling authorities.
The greek word exousia also translates to power however, is used more commonly in an individualistic sense and relates to capacity, competency, freedom, liberty.
Since English is not Greek, and thus more easily manipulated, We The People must be sharp, educated and maintain power in the exousia as well as dunamis sense of the word. Because of course, nobody gets a free lunch card issued at birth, but everyone has the right to earn a lunch each day.
Understanding the US Constitution is the individual right or power of each person living by the ruling document provisions.
By reading the following excerpt one can visualize the most basic right provided by the Constitution:
At the hearing on the writ of habeas corpus, the judge hears sworn testimony. If he determines that the prisoner is being held without just cause, he orders the jailer to release him, and the jailer is required to comply with the judge’s order. In our example, the judge might say, “The First Amendment to the Constitution guarantees the right of people to criticize their government and its policies and there are no exceptions for crises or emergencies, including war. The law that converts government critics into aiders and abetters of terrorism is unconstitutional. You are hereby ordered to release the petitioner immediately.” Absent appeals, the prisoner would go free at the conclusion of the hearing. In the event of appeals, petitions for writ of habeas corpus are usually given priority over most other appellate cases.

It is clear that the prisoner in the above quotation is given a provisional right exousia guaranteed by the Constitution. If the judge had failed to observe the Constitution, it would have been the prisoners responsibility to know his rights and enforce justice in the court room.
Habaes Corpus has to do with Article I. of the Bill of Rights and also Article VI. "Freedom of Speech" being guaranteed in the First and access to "the assistance of Counsel for his defence".
In Conclusion:
The Constitution is a simple document constructed to deal with complex problems, and it guarantees an individual can have dunamis, ie. force, strength and power to protect ones own property and life. It is however, up to the people to understand basic rights and the rules government must be held accountable to observe.
